Educational ADA / Section 504 evaluations
Evaluations conducted to determine whether an individual has a qualifying condition under the Americans with Disabilities Act of 1990 (42 U.S.C. § 12101 et seq.) and Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. § 794), and to provide documentation supporting reasonable accommodations when appropriate.
Eligibility for Legal Protections under ADA
Evaluations addressing whether an individual’s mental health–related symptoms meet criteria for a qualifying condition under the Americans with Disabilities Act (ADA). Such assessments may be requested when an employee seeks a workplace accommodation, when an employer requires clarification regarding whether observed workplace behaviors may be associated with a disability, or when an employee is preparing to return to work following an extended absence for mental health treatment.
Workplace Disability/ Claims for Benefits
- Private disability evaluations determine whether a mental health condition prevents an individual from working according to the criteria of a privately purchased disability insurance policy.
- Employer-paid disability evaluations assess how psychological symptoms affect an employee’s ability to perform their job under an employer-sponsored disability plan.
- Workers’ compensation evaluations determine whether a psychological condition was caused or worsened by workplace events and how it impacts the employee’s work capacity.
Personal Injury
Evaluations addressing the emotional, cognitive, or psychological effects someone may experience after an accident or injury, helping determine how the event impacted their mental functioning and daily life.
Testamentary Capacity
Evaluations addressing an individual’s ability to understand the nature and consequences of decisions related to wills, estates, or similar civil matters. These assessments consider cognitive, psychological, and contextual factors relevant to the person’s capacity at the time of the evaluation (or retrospectively, when appropriate and feasible).
Referral Sources
The ACCESS Program accepts referrals from a variety of civil and institutional sources, including:
- Attorneys and law firms (civil litigation, employment, disability, estate planning)
- Universities, colleges, and professional schools seeking ADA/Section 504 evaluations
- Employers and human resources departments requesting workplace accommodation evaluations
- Insurance carriers and third-party administrators for private disability or workers’ compensation claims
- Courts or court-appointed entities in civil matters where psychological evaluation is indicated
We do not accept referrals from individuals or families.
All referrals are reviewed to ensure that the requested evaluation falls within the scope of ACCESS services, and if not, appropriate referrals to other programs are offered.
